By accepting electronically (for example, clicking "I Agree"), installing, accessing or using the Services, you agree to these terms.

We also have a Privacy Policy, we encourage you to read through them to know more about how your data is protected.

Using Our Services

Before using our services you must be aware of the following:

About us:

  • You are contracting with Quicko Infosoft Private Limited and/or its subsidiaries and affiliates (referred to as “Quicko Pro”, "We", "Our", or "Us").
  • Our business is based in India.

Term modifications:

  • We reserve the right to implement changes to our Services or the Terms of Service that could impact your use of these services or your associated rights.
  • We will not be liable for any modifications, price changes, suspension or cancellations of the services by Workspace.
  • You are encouraged to regularly review these terms to stay informed about any updates. Few scenarios where we may change the terms:

Age Requirement:

  • You must be at least 18 years or above to enjoy our services.

User Registration:

  • You will need to create an account with us. Please ensure to keep your password a secret because you're responsible for anything that happens using your account.
  • If you pick a username that we think isn't okay (example: it's offensive or inappropriate), we might need to change or remove it.

User Account:

  • You can view your account via login ID and password.
  • You can delete your account at any time. We clean up data periodically.
  • You are solely responsible for managing your account, ensuring the integrity and compliance of all materials you upload, and overseeing the operations of your Workspace. Any violations of our terms of service may result in the termination of your account access.
  • Inaccurate registration information may result in account suspension.
  • If you suspect unauthorised use or knowledge of your account, please promptly notify us by submitting a request.

Legal and Regulatory Compliance:

  • We may need to make adjustments to comply with new laws or regulations.
  • This includes changes to meet legal obligations or government directives.

Fraud and Abuse Prevention:

  • To enhance the security of the platform and protect against fraudulent activities, we may update terms and services.
  • This ensures a safer environment for all users by preventing misuse and abuse.

Security Enhancements:

  • Updates may be necessary to address security vulnerabilities or threats.
  • These changes aim to safeguard the integrity and confidentiality of the platform and user data.

Restriction of Services:

  • We may restrict or prohibit products or services deemed unsafe, inappropriate, or offensive.
  • This is to maintain a respectful and secure platform for all users.

Service Availability & Modifications:

  • We retain the right to modify, suspend, or discontinue any aspect of the service at any time.
  • We may refuse or remove any materials, including those within your Workspace, at our discretion.

Competitor Usage:

  • Your competitors may use our services; however, we will never share your confidential information with them.

Account Ownership & Disputes:

  • In cases of ownership disputes, we may freeze or transfer accounts to the rightful owner as determined by us.
  • If ownership cannot be reasonably determined, we may temporarily suspend or disable the account until the dispute is resolved.

Workspace Terms

Workspaces are independent service providers offering professional services through Quicko Pro, including consulting, support, training, and other specialized services.

Role: Workspaces create and manage their service offerings, set their own terms and conditions for service delivery, and interact directly with Customers to provide agreed-upon services.

Workspace Creation & Management:

  • Workspace Setup: A Workspace is initially created by an individual designated as the Owner.
  • Inviting Team Members: Owners and Managers can invite other individuals to join the Workspace via email.
  • Accepting Invitations: Invitees must accept the invitation to gain access, with permissions assigned based on their designated role.
  • Role Changes & Access Management: Owners have full authority to modify user roles and revoke access as necessary to maintain security and operational integrity.

Service Integration:

  • Quicko Pro provides tools for customer management, scheduling, communication, and documentation to enhance service delivery.
  • Workspaces are responsible for utilizing these features effectively to manage their customer interactions.
  • Workspaces must handle any defects, legal disclosures, regulatory requirements, and promotional content associated with their products or services.

Workspace Responsibility:

  • Workspaces are fully responsible for the services they offer on Quicko Pro. This includes setting accurate service descriptions, pricing, availability, and handling all customer interactions in a professional and timely manner.
  • Each Workspace is required to provide clear and up-to-date contact information, define their own terms of use, and select appropriate booking and cancellation policies to guide customer expectations and transactions.
  • Workspaces should also include their specific service terms, if applicable.

Workspace Rights:

  • Workspaces have the right to modify or update their service offerings, pricing, and availability at their discretion.
  • They may configure their workspace settings and stop their services, provided all existing obligations to customers are fulfilled.
  • Workspaces are entitled to receive payments for the services they provide, subject to the applicable terms.
  • Workspaces have the right to communicate directly with customers regarding bookings.
  • Workspaces have the right to access and use customer data and documents solely for the purpose of delivering the agreed-upon services.
  • They may delete workspace data once all bookings are fulfilled and in accordance with applicable terms.

Seller of Record:

  • We are not the seller and have no responsibility for the Services.

Intellectual Property Protection:

  • Workspaces must not reproduce, duplicate, copy, sell, resell, or exploit any portion of Quicko Pro without express written permission.

Unauthorized Activities:

  • Workspaces must not engage in unauthorized framing, linking, or use of the Services for unlawful activities.

Impersonation and Account Security:

  • Workspace Members must not impersonate other users or use their account credentials.

Harassment and Misconduct:

  • Workspaces must refrain from harassing, intimidating, or threatening Quicko Pro’s employees, agents, or other users.

Software Integrity:

  • Workspaces must not copy, modify, or tamper with Quicko Pro’s software, including HTML, JavaScript, images, or any other code.

Content Ownership:

  • Workspaces retain copyright and proprietary rights over their own content they upload (e.g. images, videos, cover photos, and profile pictures).

Automated Interference:

  • Workspaces must not engage in automated use of the system, such as web scraping, robotic process automation, or other data-gathering tools.

Reputation Protection:

  • Workspaces must not engage in actions that disparage, tarnish, or harm Quicko Pro or its Services.

Security Compliance:

  • Workspaces must not circumvent or interfere with the security-related features of Quicko Pro or engage in any other unauthorized use of the Services.

Dispute Resolution:

  • In the event of a dispute between a Workspace and Customer, both parties are encouraged to resolve the issue directly.
  • Quicko Pro may assist in facilitating communication but does not mediate or resolve disputes.
  • Workspaces must contact their Customers directly for any service-related concerns, modifications, or grievances.

Limitation of Liability:

  • Quicko Pro acts solely as a facilitator, connecting Workspaces with Customers, and is not responsible for service fulfillment, quality, or outcomes.
  • Workspaces are fully accountable for their services, including bookings, modifications, cancellations, and dispute resolution.
  • Quicko Pro does not warrant or guarantee the accuracy, availability, or outcome of any services listed by Workspaces.
  • Quicko Pro disclaims liability for any issues arising from the conduct, performance, or operations of Workspaces and their associated parties.
  • Workspaces must ensure compliance with all relevant legal and regulatory requirements.
  • Quicko Pro shall not be held liable for any actions, omissions, or service-related responsibilities of Workspaces.
  • Workspaces are responsible for handling customer data, and Quicko Pro bears no liability for data practices, security breaches, or unauthorized disclosures arising from Workspace actions.

Compliance with Laws:

  • Workspaces must comply with all relevant laws, regulations, and policies.
  • Workspaces must ensure that their members, agents, and subcontractors comply with all applicable laws, regulations, and the terms of this agreement.
  • Any illegal activities, fraudulent behaviour, or violations of these terms may result in Workspace suspension or termination.

Storefront Terms

The Storefront becomes available automatically once a Workspace is activated and enables their services. Customers can explore a variety of services offered by Workspaces to meet their personal or business needs.

Role: The Storefront serves as a marketplace where Customers can browse and select services offered by Workspaces.

Booking Process:

  • Customers can browse and book services available on the Storefront through Quicko Pro.
  • Before confirming a booking, Customers should carefully review all service details, including: Service description, Pricing, Availability, Specific terms set by the Workspaces (e.g., Terms of Use, Refund &Cancellation, and Rescheduling policies)
  • Upon booking confirmation, Customers will receive an email containing the Service details, Scheduled date and time, Additional instructions from the Workspace, if applicable.

Service Providers:

  • Each Workspace is solely responsible for the accuracy, quality, and fulfillment of the services they provide.
  • Workspaces set their own terms, including pricing, availability, rescheduling, and cancellation & refund policies.
  • Quicko Pro acts as a facilitator and is not responsible for the services listed, provided, or modified by Workspaces.

Customer Responsibilities:

  • Customers should review the Terms of Use of the Workspace to understand how their data will be handled.
  • Customers should take necessary precautions when sharing sensitive information with Workspaces.
  • Customers must provide accurate and complete information when making a booking.
  • Customers should ensure they understand and agree to the terms set by the Workspace before finalizing a booking.
  • If a service requires preparation or specific requirements, Customers must comply with any pre-service instructions provided by the Workspace.
  • Customers must adhere to the terms, policies and guidelines of the respective Workspace they book services from.

Customer Rights:

  • Customers have the right to delete their personal data, including uploaded files, account information, and any associated data.
  • Customers have the right to clear and upfront information about service pricing, fees before confirming a booking.
  • Customers are entitled to receive the services as described at the time of booking.
  • Refunds are subject to the Workspace’s Cancellation and Refund Policy, which is available to customers prior to booking.
  • Customers have the right to communicate with the Workspace regarding bookings, service details, and any clarifications to services booked.

Prohibited Activities

Customers using Storefront must not engage in the following activities:

Fraudulent Bookings

  • Making fake bookings with no intent to use the service.
  • Using false information (e.g., fake names, unauthorized payment methods) when booking a service.

Abusive Behaviour

  • Engaging in harassment, threats, or abusive language toward Workspace Members, Quicko Pro support, or other users.
  • Attempting to coerce or manipulate Workspace Members into providing unauthorized services.
  • Posting or sharing false, defamatory, or misleading reviews or complaints.

Unlawful Activities

  • Engage in illegal, deceptive, or unethical business practices.
  • Violating any intellectual property rights of Quicko Pro, Workspaces, or third parties.

Dispute Resolution:

  • In the event of a dispute between a Customer and a Workspace, both parties are encouraged to resolve the issue directly.
  • Quicko Pro may assist in facilitating communication but does not mediate or resolve disputes.
  • Customers must contact the Workspace directly for any service-related concerns, modifications, or grievances.

Limitation of Liability:

  • Quicko Pro serves as a platform for connecting Customers with Workspaces and is not responsible for service fulfillment, quality, or customer satisfaction.
  • Quicko Pro does not guarantee the availability, accuracy, or outcome of any service listed on the Storefront.
  • Customers acknowledge that Quicko Pro is not liable for any issues arising from bookings, cancellations, or modifications made by a Workspace.
  • Quicko Pro is not responsible for the data practices, policies, or security measures implemented by Workspaces.
  • Quicko Pro shall not be liable for any data breach or unauthorized disclosure of information resulting from documents shared by Customers with Workspaces.

Feedback and Reviews:

  • Customers are encouraged to provide feedback and reviews of services received from Workspaces.
  • Honest and constructive feedback helps Workspaces improve service quality and customer satisfaction.
  • Reviews should be based on genuine experiences and be respectful and fair.
  • Any false, misleading, or inappropriate reviews may be subject to removal.

Compliance with Laws:

  • Customers must comply with all relevant laws, regulations, and policies.
  • Any illegal activities, fraudulent behaviour, or violations of these terms may result in account suspension or termination.

Payment Terms

Secure & Reliable Transactions:

  • All payments on Quicko Pro are securely processed through an RBI-licensed Payment Gateway Partner, ensuring a seamless, efficient, and protected transaction experience.

Comprehensive Payment Handling:

Quicko Pro relies on its Payment Gateway Partner for managing all financial transactions, including:

  • Service Payments: Processing customer payments for Workspace services.
  • Refunds & Returns: Handling eligible refunds per applicable policies.
  • Payment Disputes: Resolving chargebacks and disputed transactions, as governed by the Payment Gateway Partner’s terms.

Secure & Transparent Payments with Escrow Protection

We’re committed to ensuring secure and fair transactions for both Customers and Workspaces.

  • When a Customer books a service, the payment is processed through our trusted Payment Gateway Partner and temporarily held in an escrow account.
  • The funds are not immediately released to the Workspace.
  • Once the service has been marked as ‘Completed’ by the Workspace, the Payment Gateway Partner is notified to release the funds from the escrow account and transfer them to the Workspace.
  • Payouts are processed according to scheduled settlement cycles set by the Payment Gateway Partner.
  • In the event of a cancellation, refunds will be issued to either the Customer or the Workspace in accordance with the applicable cancellation policy.

No Direct Handling by Workspace:

  • Workspace does not process or manage payments directly.
  • Its sole responsibility is customer service and service fulfillment.
  • Any billing or payment-related concerns should be addressed directly through the Payment Gateway Partner’s support or Quicko Pro’s helpdesk.

Multiple Payment Options:

  • The Payment Gateway Partner supports various payment methods, including credit/debit cards, UPI, and net banking allowing for convenient transactions.

Transaction Security & Compliance:

  • Payment Gateway Partner ensures that all payments are processed with high security standards and data encryption to protect information.

GST Invoicing:

  • Workspaces may list services as GST-inclusive or exclusive based on their preference.
  • Customers must provide required GST details while purchasing services to claim GST benefits.
  • Customers and Workspaces bear responsibility for any applicable taxes related to the services.

Reschedule, Cancellation, and Refund Terms:

Rescheduling:

Workspaces set their rescheduling policies for all bookings made through their Storefront. Options include:

  • Strict: No rescheduling once a booking is confirmed.
  • Moderate (Default): Rescheduling allowed but not on the same calendar day as the booking.
  • Flexible: Rescheduling permitted at any time before the booking starts.

Customers must comply with the policy set by the respective Workspace. Quicko Pro is not responsible for enforcing or modifying rescheduling requests.

Cancellation & Refund:

Workspaces define their own Cancellation & Refund policy, communicated at the time of booking:

  • Strict: No refunds for cancellations.
  • Moderate (Default): Full refund if canceled before the calendar day of the booking.
  • Flexible: Full refund if canceled at any time before the booking starts.

Customers must review and understand cancellation terms before booking a service.

Cancellation by Customer:

  • If the cancellation is within the Workspace’s policy, the refund will be processed to the original payment method.
  • If the cancellation is outside the policy, the amount will be settled with the Workspace and no refund will be issued.

Plan Modification:

  • Customers may modify their plan by selecting a new one.
  • Upon modification, the original plan is automatically canceled, and the new plan takes effect immediately.
  • Refunds for the canceled plan will be processed only after successful payment for the new plan.
  • Customers may retain their previously assigned professional or opt for a new one, subject to system availability.
  • Refund details for canceled plans will be communicated via email or available in the Booking Summary section.
  • Plan modifications, once completed, are final.

Customers are advised to carefully review plan details before making changes.

Third Party Service Terms

Integration with Third-Party Services:

  • Quicko Pro integrates with third-party applications to facilitate scheduling and communication between Workspace and Customers.
  • These integrations are offered for convenience and are governed by the respective third-party terms and policies.

No Responsibility for Third-Party Services:

  • Workspace and Customers acknowledge that their use of third-party applications is at their own risk and discretion.
  • It is the responsibility of each Workspace and Customer to review and comply with the terms, conditions, and privacy policies of these services before using them.
  • Quicko Pro does not control or oversee the functioning of third-party applications.

No Endorsement or Warranty:

  • The inclusion of third-party integrations within Quicko Pro does not imply endorsement, sponsorship, or affiliation.
  • Quicko Pro makes no warranties regarding the availability, reliability, or security of third-party services and assumes no responsibility for their performance.

Data Access & Sharing:

  • By enabling or using third-party services within Quicko Pro, Workspace and Customers grant permission for such services to access necessary data for interoperability.
  • Any exchange, modification, or loss of data resulting from these integrations is solely between the Workspace, Customers and the third-party provider.
  • Quicko Pro is not responsible for any unauthorized access, deletion, or modification of data by third-party applications.

Service Availability & Modification:

  • Quicko Pro does not guarantee the continuous availability of third-party integrations.
  • Quicko Pro reserves the right to modify, disable, or discontinue access to any third-party service at any time without prior notice.

Dispute Resolution & Third-Party Services:

  • Quicko Pro is not responsible for resolving disputes between Workspace, Customers and third-party service providers.
  • Any issues related to third-party applications must be addressed directly with the respective provider.

Limitation of Liability:

  • Under no circumstances shall Quicko Pro be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of third-party services.
  • This includes but is not limited to service disruptions, data loss, security breaches, or any financial losses incurred due to third-party applications.

General Terms

Content and Data

Some of our services are designed to let you upload, submit, store, send, receive, or share your personal information. You have no obligation to provide any content to our services and you’re free to choose the content that you want to provide. If you decide to provide content, ensure you have the necessary rights and that it complies with the law.

User data:

  • We may retain the data you provide for the purpose of providing our Services to you.
  • We do not share your data with any third parties without taking prior consent from you.
  • We keep your data safe from any unauthorised use.
  • We do not share or sell your data to any third party, your data is used safely by our internal products and services only.
  • You are responsible for all the data you provide and any data related to your activities using our Services.

Our Content:

  • You agree not to use any intellectual property rights, title, or interest (“IPR”) in the contents of our Platform.
  • The structure, colour, and other creative details of our website are proprietary to us.
  • Trademarks, copyrights, and patents used by either party are the sole property of their respective owners.
  • You grant us the rights to host, use, process, analyse, store, display, transmit, and retain your data for providing our Services.
  • No assignment or licence of any of our trademark or service mark or any other Intellectual Property Right is granted to you, except as expressly set out.
  • You are not authorised to use or infringe upon our Intellectual Property Rights and must comply with these terms and other policies.

Your Content:

  • We do not claim ownership of the Materials you provide to us.
  • You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide right and licence to Host, Use, Distribute, Expose, Modify, Run, Copy, Store, Publicly perform, Communicate to the public (including by telecommunication), Broadcast, Reproduce, Make available, Display, Translate, Create derivative works of any Materials provided by you in connection with the Services.
  • We may use our rights under this licence to operate, provide, and promote the Services, and to fulfil our obligations and exercise our rights under the Terms of Service.
  • You represent, warrant, and agree that you have all necessary rights in the Materials to grant this licence.
  • You irrevocably waive any and all moral rights you may have in the Materials in favour of us and agree that this waiver may be invoked by anyone who obtains rights in the materials through us, including anyone to whom we may transfer or grant (including by way of licence or sublicense) any rights in the Materials.
  • You can remove your data at any time by deleting your Account. Removing your Account does not terminate any rights or licences granted.
  • You agree that we can, at any time, review and delete any or all of the Materials submitted to the Services, although we are not obligated to do so.
  • This licence will survive any termination of the Terms of Service solely to the extent that we require the licence to exercise any rights or perform any obligations that arose during the Term.

Data Protection:

  • We prioritise data privacy and security.
  • By using our Services, you agree to our Privacy Policy.
  • We may maintain or use your data according to our Privacy Policy.
  • Our Services are hosted in India, and if you access them from any other region, your data will be transferred to India with your express consent.
  • We take appropriate measures to safeguard the security, confidentiality, and integrity of your data and prevent unauthorised access.

Communications:

  • By providing personal contact information, you consent to receive marketing communications from us.
  • Marketing communications may include SMS, electronic communications, and promotional emails.
  • You can unsubscribe at any time by clicking the "unsubscribe" link in the footer of our emails or by contacting us at help@quicko.pro.

Grievance and Resolution

You are entitled to receive services of a certain standard and quality, and you have the right and remedies to resolve any issues if things do not go as expected under these terms.

Disclaimer:

  • As our services are provided on an AS-IS and AS-AVAILABLE BASIS, we can only commit to our services.
  • Your use of our Services is at your own risk.
  • We make no warranties about the accuracy or completeness of the content or linked websites.
  • We are not liable for errors, personal injury, unauthorised access, interruptions, or transmission issues.
  • We are not responsible for any viruses, third-party products, or advertised services.
  • We do take any responsibility for hyperlinked websites or featured advertisements.

Governing Law and Dispute Resolution:

  • Our services are governed by the laws of India.
  • The exclusive jurisdiction for resolving any disputes related to our services lies with the courts, tribunals, councils, forums, and other dispute resolution bodies in Ahmedabad, India.
  • Disputes or claims will be resolved through Alternative Dispute Resolution methods (example: mediation, arbitration, or negotiation), in accordance with applicable laws.

Liabilities:

  • Quicko and its subsidiary companies are not liable for any damages resulting from your use or inability to use the Services, including loss of profits or data.
  • We are not responsible for damages or lawsuits that arise if you break the law, breach these terms or go against the rights of a third party. We provide no warranties and our liability is limited in the event of errors or interruptions.
  • You are responsible for any breach of the Terms of Service by you, your affiliates, managers, members and agents, or subcontractors, and will be liable as if it were your own breach.
  • We do not warrant that the services will be uninterrupted, timely, secure, or error-free.
  • We do not warrant that the results obtained from the use of the services will be accurate or reliable.
  • We are not responsible for any of your tax obligations or liabilities related to the use of our Services.
  • We do not warrant that the quality of any products, services, information, or other materials purchased or obtained by you through the Services will meet your expectations.
  • Quicko and its subsidiary companies are not responsible for indirect or consequential damages, such as any interest and penalties levied by the Government, losses due to technology failures, data corruption, or loss of business..
  • You agree to protect and hold Quicko harmless from any claims or legal actions brought against them due to your actions or mistakes.
  • If legal proceedings arise, both parties must notify each other within five days and have the opportunity to participate and defend themselves.
  • The indemnity clause remains in effect even after the use of services ends. Claims related to indemnities cannot be made more than 30 days after the termination of services.

Action:

  • We may terminate your account access to our Platform at any time if we see any suspicion of fraud, hacking, phishing, harassment, spamming, misleading others, unauthorised content scraping, illegal activity, unauthorised access, or non-compliance with these terms.
  • If your account is terminated, you are prohibited from creating a new account under your name or any third party's name.
  • It is required to comply with a legal requirement or court order.

Feedback:

  • We are open to feedback but are under no obligation to ensure that ideas and suggestions remain confidential and we can use the feedback in any way we want.
